Litigation
Mr. Grubman began his legal career in the litigation department of the national and regional law firms of Manatt Phelps & Phillips, Ruden McClosky Smith Schuster & Russell and Morgan Lewis & Bockius. He subsequently became a litigation partner in the Miami law firm of Herman & Grubman and the Boca Raton law firm of Stollman & Grubman.
During his legal career, Mr. Grubman has worked on a wide variety of complex civil litigation matters in both state and federal court at the trial and appellate levels. Mr. Grubman’s substantive legal experience includes business and partnership disputes, shareholder derivative actions, copyright infringement, trademark infringement, trade secrets, patent infringement, entertainment litigation, Uniform Commercial Code disputes, probate and trust litigation, securities litigation and arbitration, real estate litigation, business torts, disputes involving non-compete agreements, breach of contract claims across a broad spectrum of industries, franchise disputes, breach of fiduciary duty and fraud, tortious interference, commercial aviation, and replevin.
Mr. Grubman’s clients benefit from his nineteen years of experience litigating complex cases. However, unlike clients of large law firms who often deal with young attorneys instead of the partners they hired, Mr. Grubman’s clients deal directly with him. One of the benefits of Mr. Grubman’s direct involvement at every stage of a litigation matter is that he continually evaluates the most effective and efficient way for his clients to accomplish their goals.
Depending upon the merits and circumstances of a particular case, Mr. Grubman offers his clients a variety of fee arrangements. These arrangements include full contingency fees, straight hourly, a blend of a reduced hourly rate with a reduced contingency percentage, and flat fees. Mr. Grubman often acts as co-counsel with attorneys from law firms within and outside of South Florida.
Although Mr. Grubman has a broad base of complex civil litigation experience, he spends a considerable amount of time in the following substantive areas:
- Entertainment and Intellectual Property Litigation
Mr. Grubman has substantial experience representing clients in intellectual property and entertainment litigation matters, including breach of contract and tort claims, copyright infringement, trademark infringement, and trade secret claims. He regularly represents major record companies, independent record companies, recording artists, managers, songwriters, actors and actresses.
Mr. Grubman acts as counsel for some of the largest entertainment companies in the world in entertainment and intellectual property litigation in Florida. He has represented Universal Records, EMI, Warner Chappell, Sony Discos, Sony/ATV Music Publishing, Atlantic Records and Island Def Jam, among others. Mr. Grubman also acts as local litigation counsel for clients referred to him by transactional entertainment attorneys in New York, Los Angeles and Nashville.
- Probate and Trust Litigation
Mr. Grubman represents personal representatives, trustees, trust beneficiaries, and minors in probate, trust and guardianship litigation proceedings. These claims include trustee fee disputes, will contests, breach of fiduciary duty, undue influence and fraud claims. Mr. Grubman has written and lectured extensively to investor groups, lawyers, accountants, financial planners, and stockbrokers regarding fiduciary responsibilities.
- Business and Securities Litigation
Mr. Grubman has represented parties in partnership disputes and disputes among shareholders in closely held corporations. He has also acted as counsel in shareholder derivative actions and direct actions against officers and directors for breach of fiduciary duty, breach of loyalty and usurpation of corporate opportunities. Mr. Grubman has also represented brokerage firms, stockbrokers and brokerage customers in arbitration proceedings before the NASD and NYSE.
