PROBATE/TRUST

As an attorney, Mr. Grubman has represented personal representatives, trustees, trust beneficiaries and minors in probate, trust and guardianship litigation proceedings.  These claims have included trustee fee disputes, will contests, prudent investor rule, breach of fiduciary duty, undue influence and fraud claims.  Mr. Grubman has also written and lectured extensively to investor groups, lawyers, accountants, financial planners, and stockbrokers regarding fiduciary responsibilities.

Consistent with his active and evaluative approach to mediating, Mr. Grubman has utilized the knowledge he has acquired from litigating probate and trust matters to assist the parties and their counsel in resolving probate and trust disputes.  Mr. Grubman has noticed that probate and trust attorneys (at least those in South Florida) tend to utilize other probate/trust attorneys to serve as mediators in their cases.  They do this because they feel that most mediators do not have an adequate understanding of the law and procedure in probate and trust matters to assist the parties effectively in resolving disputes.  Fortunately, Mr. Grubman has both the experience of litigating trust and probate cases as well as substantial experience as a mediator.  This combination has proven quite effective in assisting the parties in resolving their probate/trust disputes.
